These Terms & Conditions (“terms”) apply to your use of the https://cb1pharmacy.com/ website (“Website”/”site”) and every order placed with CB1 Pharmacy as set out below. CB1 Pharmacy means a company incorporated in England and Wales under company number 13950590 whose registered office is, 73 Cornhill, London, England, EC3V 3QQ and is referred to in these Terms as “CB1 Pharmacy”/“we”/“us”/“our”. CB1 Pharmacy is registered with the General Pharmaceutical Council – registration number: 9012061).

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

The Site may contain (or you may be sent via the Site) links to other websites (“Third-Party Websites”) as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, applications, software, and other content or items belonging to or originating from third parties (“Third-Party Content”).

Such Third-Party Websites and Third-Party Content are not investigated, monitored, or checked for accuracy, appropriateness, or completeness by us, and we are not responsible for any Third-Party Websites accessed through the Site or any Third-Party Content posted on, available through, or installed from the Site, including the content, accuracy, offensiveness, opinions, reliability, privacy practices, or other policies of or contained in the Third-Party Websites or the Third-Party Content.

You should review the applicable terms and policies, including privacy and data gathering practices, of any website to which you navigate from the Site or relating to any applications you use or install from the Site. Any purchases you make through Third-Party Websites will be through other websitesvand from other companies, and we take no responsibility whatsoever in relation to such purchases which are exclusively between you and the applicable third party.

You agree and acknowledge that we do not endorse the products or services offered on Third-Party Websites and you shall hold us harmless from any harm caused by your purchase of such products or services. Additionally, you shall hold us harmless from any losses sustained by you or harm caused to you relating to or resulting in any way from any Third-Party Content or any contact with Third-Party Websites.

What is CB1 Pharmacy?

CB1 Pharmacy is a web-based service that enables you (the “Account Holder”) to process current or repeat prescriptions from your prescribing doctor or other registered doctor for delivery through a Partner.

Approved prescriptions will be transmitted to and dispensed by CB1 Pharmacy’s pharmacy. The Account Holder can also make requests on behalf of someone that they are acting as a carer for if they have been given authority to represent them (proxy access). In addition, a doctor may be an Account Holder for the purposes of obtaining products for which he/she has issued a prescription.

The Account Holders’ contract with us is only to provide an intermediary/facilitation service.

How does CB1 Pharmacy work?

Access the CB1 Pharmacy website referred to above, register your details and confirm you have a prescription. The CB1 Pharmacy will be in touch to obtain the relevant information and to verify your identity. Once an order has been placed, the transaction is processed manually at the premises of CB1 Pharmacy by its registered pharmacists who are members of the General Pharmaceutical Council. This website should be regarded as an invitation to treat. Any order placed by a customer is an offer to purchase, which CB1 Pharmacy may accept or decline in its absolute discretion without having to give a reason. A contract is deemed to be made at the point of a sale invoice being issued by CB1 Pharmacy following checking of orders by a pharmacist. We only deliver prescription medication within the UK.

To register with and use this site you must be over 18 and the details which you give us must be true. The contents of this website are directed solely to those who access the site from the UK. Risk and title in the products will pass to you when they are despatched by us to you, from the UK, and you acknowledge and agree to be responsible for complying with any restrictions around the receipt and use by you of the products.

You agree that CB1 Pharmacy and CB1 Pharmacy’s pharmacy may contact you in order to manage your order and any orders you placed on behalf of a patient that you have been authorised to act as a proxy for. This can include contact via the website, telephone, sms, email or post. If we are not able to contact you, we may be unable to dispense your prescription.

CB1 Pharmacy will endeavour to ensure that all prescription and medicines prices are correct on the website. In some cases, the prices may vary due to manufacturer price increase, product availability and/or special-order requirement. In such cases CB1 Pharmacy will contact you on receipt of the prescription to inform you of any price difference. We are legally only able to dispense medicines for you when we have received either an electronic prescription which has been digitally signed by a prescribing doctor or alternatively a conventional paper prescription signed in writing by a prescribing doctor. prescriptions are issued entirely at the discretion of the prescriber.

Can I manage other people’s  medication using CB1 Pharmacy?

Yes, if you are at least eighteen (18) years old and have been authorised to act on behalf of another or have the authority to represent someone else (as their proxy). If you wish to sign up as a proxy for someone else, you must first obtain consent from the patient. By signing up for someone as a proxy, you confirm that you have obtained consent from that person to act as their proxy to manage their medication. As part of our safeguarding responsibilities, we may need to verify your identity when handling prescriptions for safe custody controlled drugs. Please note this may result in an increase in the time taken to dispatching your medication.

Who is liable if something goes wrong?

There are different parties which make up the overall service provision to you and have different responsibilities and liabilities under these Terms or otherwise. We have separated these out below.

You are responsible for complying with these Terms. Please see the section below “What are my obligations?” for further details.


CB1 Pharmacy obligations

CB1 Pharmacy is liable for ensuring that these prescriptions are dispensed correctly and in accordance with General Pharmaceutical Council standards and guidelines and these Terms.

CB1 Pharmacy: is responsible for providing the Service in accordance with these Terms.

CB1 Pharmacy separately accept liability for death or personal injury caused by its negligence and do not seek to exclude liability for fraudulent misrepresentation. You have certain legal rights. These include that CB1 Pharmacy will provide the Service with reasonable skill and care and within a reasonable time and in accordance with the descriptions provided and that CB1 Pharmacy will dispense the agreed prescription. You have certain legal remedies if CB1 Pharmacy breach any of these rights. Nothing in these Terms is intended to affect these legal rights or other rights to which you may also be entitled. For more information on your legal rights contact your local Citizens Advice Service.

CB1 Pharmacy are not responsible for any failures or delays caused by you, the prescribing doctor, a Partner or Royal Mail or for the failures or delays of each other.

CB1 Pharmacy is not responsible for losses not caused by its breach, indirect losses or a failure to provide the Service due to any cause beyond its reasonable control which prevents it from fulfilling our obligations including but not limited to fire, storm, riot, civil disturbance, war, nuclear accident, terrorist activity and acts of God.

If CB1 Pharmacy, do breach these terms it shall only be liable for losses which are a reasonably foreseeable consequence of such a breach. Losses are foreseeable where they could be contemplated by you and CB1 Pharmacy as relevant at the time of entering these Terms.

CB1 Pharmacy has taken care in the preparation of the content of this web site. To the fullest extent permitted by the law, CB1 Pharmacy disclaims all warranties of any kind with respect to the content of this web site. CB1 Pharmacy and its directors or related companies shall not be liable for any losses or claims arising directly or indirectly from use of this web site except that this exclusion of liability does not apply to any damages in connection with death or personal injury caused by the negligence of CB1 Pharmacy, its directors or employees. All content of this web site is for information purposes only and is not a substitute for professional medical advice, rather it is designed to support, not replace, the relationship between you and your healthcare providers. You should make sure that you carefully read all product packaging and labels prior to use.

The following parties are not subject to these Terms but carry certain responsibilities and obligations to you as set out below. In the event of an issue you should contact CB1 Pharmacy in the first instance and we may direct you to contact your prescribing doctor, the relevant Partner or Royal Mail as appropriate.

Your prescribing doctor: Your prescribing doctor is not a party to these Term but they are responsible for issuing prescriptions in a timely manner and providing medical advice. Please note that all prescribing decisions are made by the prescribing doctor, not CB1 Pharmacy.

Our Partners: no Partner is a party to these Terms.
Royal Mail: is responsible for delivering medication orders that you place via CB1 Pharmacy. They are also responsible for delivering any paper prescriptions posted to CB1 Pharmacy’s pharmacy. Royal Mail is not a party to these Terms and have separate terms that cover the provision of their delivery service which you can review here: https://www.royalmail.com/terms-and-conditions.


What are my obligations?

You, the Account Holder, are responsible for the information you provide to us about yourself, your prescribing doctor and your medication; this extends to when you are using CB1 Pharmacy on behalf of someone else as their proxy.

You confirm that all information provided to us is and remains accurate. If you do not provide accurate information you could be putting yourself or the person you are managing medication for at serious risk.

You are responsible for checking and taking any medication correctly. You must check the spelling and dosage information and follow the clinical directions provided with all medication. You should review the patient information leaflet provided with the medication. If at any point the information that appears on CB1 Pharmacy contradicts the information provided by your prescribing doctor please contact us immediately. You agree that the information provided by your prescribing doctor and in the patient information leaflet take precedence over any information provided by CB1 Pharmacy.

You confirm that you are requesting medications for your own personal use only or the use of someone you are acting as a proxy for. Medications should never be shared with any other person.

You agree to keep your CB1 Pharmacy login details confidential and not to share them with any other person.

You agree not to use our websites or applications in any way that will damage, impair or render them less efficient.

Royal Mail and its terms and conditions will govern the delivery process.

You acknowledge that CB1 Pharmacy is not responsible for incidents relating to the storage, handling, manufacture, delivery, use, misuse or abuse of your medication. We reserve the right to suspend or terminate your access to CB1 Pharmacy at any time without notice if we have reasonable grounds to believe that you have breached any of these terms; this extends to any patients that you, the Account Holder has been authorised to act as a proxy for.

CB1 Pharmacy provides medication for patients based on their individual prescriptions. Therefore, patients must pay for their medication before it will be prepared, and an order cannot be cancelled once paid for. Only once you have paid for your prescription will a contract come into existence between you and CB1 Pharmacy and until such time as (i) your order has been accepted (ii) your prescription has been received and (iii) payment for that prescription has been made, we will not have any liability to you and it will be your responsibility to contact us within 30 days regarding any order you may have placed through our website if there is any delay.

How does payment work?

You will be charged the price on a sales invoice, subject to changes referred to in these terms. No medical information will be passed to your bank or credit card company. Payment for medication for other people that are listed on your account will also be processed in the same way.

Our payment processing platform, Total Processing, may also perform a pre-authorisation on the card you have signed up with to ensure your payment details are correct. Total Processing and its terms and conditions will govern the payment processing process.

In addition to being charged for the products ordered, you may also be charged for postage and packaging of your medication. The total amount of charges payable by you will be notified to you in advance of dispensing of medication.

Payment is only accepted by debit or credit card. Receipts will be emailed after the payment is taken. In providing payment card details, you authorise CB1 Pharmacy to take payment in full for the applicable prescription charges, postage and packing charges and any other charges that become due to us under these terms. Where you may be entitled to a refund, it will only be made using the payment gateway and/or card originally used for payment.

Your privacy

Your privacy is important to us. Please see our Privacy Policy for details of what information we collect and how we will use and protect it. The information that you send to us will be processed in accordance with our Privacy Policy. You authorise us, at any time, to use any means that we consider necessary to verify your identity and creditworthiness with any third-party providers of information.

Please note that in an emergency situation, we may need to contact a healthcare professional, social services or the emergency services without your consent, even where you have declined any of our offers to contact your prescribing doctor.

Can I cancel my order?

You can always choose to stop using the Service at any time.

You can cancel an order placed through the Service at any point until the medication is dispensed by CB1 Pharmacy’ and you will receive a full refund with the same method of payment.

You can make such cancellation by contacting us via telephone on 0116 2731233, via the website, or alternately, you can email us at info@cb1pharmacy.com.

Unfortunately, due to the nature of prescription medications, once your items have been dispensed, you will be unable to cancel the order, return the medication or receive a refund. Any unwanted medicines must be disposed of by returning the medication to a pharmacy or to any authorised location.

If you receive medication that is incorrect, dispatched in error or damaged you should contact us via telephone, or the website or alternatively at info@cb1pharmacy.com to discuss a replacement or refund.


Refund, Returns and Cancellation policies

In line with General Pharmaceutical Council guidance, CB1 Pharmacy does not offer refunds on medication. Once medication has been dispensed, it cannot be reused and must be disposed of. Unfortunately, we cannot accept the return of any medication that has left our premises as it cannot be reused once it has left our premises. The pharmacist must destroy any medication that is returned to us, even un-opened boxes, so we are not able to offer refunds once your medication has been dispatched.

In the first instance, if you do not find your medication suitable, this must be discussed with your prescribing doctor.

Please check the items dispensed to you carefully and promptly upon receipt. If you believe there may have been a dispensing error, you should contact us immediately and should not take or use any of the items. Please contact us to report an error as soon as possible. Where an error has been made by CB1 Pharmacy in dispensing your medication, a full refund will be given if we are notified within five days of the medication being received at the delivery address. Alternatively, we will provide you with replacement medication where possible and will arrange for collection of the previously dispensed order, so it can be safely disposed of.

Any non-medicinal products that you wish to return must be in the original packaging and unopened, in a condition fit for resale. If the product to be returned does not meet these conditions, we will be unable to offer a refund or accept the return. If these criteria are met, you must inform us of your intended return within 14 days of receiving the order, before you return it to us.

Once the return has been authorised you may send the product back to us within 28 days. Once the product has been received and checked by one of our staff, a refund will be authorised by the same method that the payment was made. This may take up to 28 working days to reach your bank account, please contact us if it has not been received after this deadline.

If the return is the patient’s decision (i.e. not due to faulty, damaged or incorrect goods) unfortunately, the patient will be liable to pay the return postage on the item. However, we will not charge a restocking fee for any items returned.

The right of cancellation and return of non-medicinal products in this clause do not affect the statutory rights of a consumer in relation to items that are faulty or not as described.

When will I receive my medication?

Your prescribing doctor may want to speak to you before prescribing so your prescription request may not be processed immediately. If you consult with your prescribing doctor, you should tell them that you would like your prescription to be sent to your ‘nominated’ pharmacy (CB1 Pharmacy). Your prescribing doctor may be delayed in issuing a repeat prescription. CB1 Pharmacy has no control over these delays; however, where possible, we will direct you to contact your prescribing doctor directly if we are informed of any issues with your request or your repeat prescription. Once the original prescription has been received by CB1 Pharmacy we will dispense the medication. We will then pack the medication and dispatch it via Royal Mail. It typically takes up to four to seven working days for us to process your prescription. We cannot guarantee the exact time and day of arrival. Royal Mail will provide you with tracking details directly once we pass them your details.

CB1 Pharmacy has no retail outlet and we are only able to take orders directly from your clinic or via a prescription you supply via post. Once dispensed, medications will be posted to the patient using the delivery method agreed at the time of order.

At the point of confirming acceptance of your order, we will endeavour to confirm the delivery time and charges for your order. These will depend on the product ordered and its availability. If we are unable to confirm details on acceptance of your order, we will do so as soon as reasonably possible thereafter.

Delivery will be made via trackable courier and will require a doorstep signature. Once the package is signed for, our responsibility for the delivery ends. Once the packaging is opened after delivery, we will have no liability to you for lost or damaged items. Due to the nature of the products being supplied from our pharmacy, there is no option for the courier to leave in a safe space, even if you request this. If no one is available at the nominated address to take delivery, the products cannot be posted through your letterbox. The courier will leave you a note informing you of how to rearrange

delivery or collect the products from a local depot. If after a failed delivery to you, you do not re-arrange delivery or collect them from a delivery depot we will contact you for further instructions and may charge you for storage costs and any further delivery costs. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection the product will be returned to the pharmacy, and we may end the contract and you will still be charged for your order.

What laws apply and what rights do I have to make a complaint?

These Terms are governed by the laws of England and Wales and any dispute, question or remedy shall be determined exclusively by the courts of England and Wales. These Terms are only available in the English language. If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the other provisions shall continue to apply. If you wish to make a complaint, you can contact us as set out below. These terms do not affect your statutory rights as a consumer.

Permission is granted to users to electronically copy or print portions of this site for their own personal, non-commercial use. Any other use of materials on this site without CB1 Pharmacy’s prior written consent is strictly prohibited. All brand names, product, service names, titles and copyrights used in this site are trademarks, trade names, service marks or copyrights of their respective holders, including members of the Group. No permission is given by CB1 Pharmacy for their use by any person other than the said holders and such use may constitute an infringement of the holders’ rights. This contract is governed by English Law.
